Acceptance of Terms
Ingamex Corporation (Ingamex) provides its service to you subject to the following Terms of Service. Ingamex reserves the right to change these terms and conditions which may be updated from time to time without any prior notification. It is the user's sole responsibility to regularly check and review these Terms of Service. All use of the Ingamex website and services is governed by the rules listed in these "Terms of Service" and "Privacy Policy".
You are responsible for reading and understanding the "Terms of Service" and "Privacy Policy" before using the Ingamex website and services.

Registration Obligations
In consideration of your use of the Service, you agree to:
(a) provide true, accurate, current and complete information about yourself as prompted by the registration form and
(b) maintain and promptly update the Registration Data to keep it true, accurate, current and complete. If you provide any information that is untrue, inaccurate, not current or incomplete, or Ingamex has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, Ingamex has the right to suspend or terminate your account and refuse any and all current or future use of the Service.
Member Account, Password and Security
You are responsible for keeping the confidentiality of your password and account and are responsible and liable for all activities that occur using your password or account. You agree to:
a) immediately notify Ingamex of any unauthorized use of your password or account or any other breach of security, and
(b) ensure that you exit from your account at the end of each session. Ingamex cannot and will not be held liable for any loss or damage arising from your failure to comply with this.
Conduct
You acknowledge that all information, data, text, game information, game data, and other materials ("Content"), whether publicly posted or privately transmitted, are the sole responsibility of the person from which such Content originated. This means that you, and not Ingamex are entirely responsible for all Content that you transmit via the Service. Ingamex does not control the Content posted via the Service and, as such, does not guarantee the accuracy, integrity or quality of such Content.
You agree to not use the Service to:
1. transmit any Content that is unlawful, harmful, threatening, abusive, harassing, tortuous, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically or otherwise objectionable;
2. impersonate any person or entity, including, but not limited to, an Ingamex official, guide or host, or falsely state or otherwise misrepresent your affiliation with a person or entity;
3. transmit any Content that you do not have a right to transmit under any law or under contractual or fiduciary relationships (such as inside information, proprietary and confidential information learned or disclosed as part of employment relationships or under nondisclosure agreements);
4. transmit any Content that infringes any patent, trademark, trade secret, copyright or other proprietary rights ("Rights") of any party;
5. transmit any unsolicited or unauthorized advertising, promotional materials, "pyramid schemes",(removed some lines) or any other form of solicitation, except in those areas (such as shopping rooms) that are designated for such purpose;
6. disrupt the normal flow of dialogue, cause a screen to "scroll" faster than other users of the Service are able to type, or otherwise act in a manner that negatively affects other users' ability to engage in real time exchanges;
7. interfere with or disrupt the Service or servers or networks connected to the Service, or disobey any requirements, procedures, policies or regulations of networks connected to the Service; or
8. intentionally or unintentionally violate any applicable law or regulation including, but not limited to, regulations promulgated by any securities exchange.
Account Verification
You may be required to supply additional information when using certain services from Ingamex. This may include a valid home phone number, additional e-mails or other forms of identification.
Due to frequent and increasing fraudulent activities, Ingamex currently DOES NOT authorize credit card accounts and/or Paypal accounts with unverified addresses and/or unconfirmed telephone numbers. Please be sure that while entering your personal information you double check ALL INFORMATION and confirm it is all current and accurate before submitting it. ALL unconfirmed/unverified purchases will be canceled upon discovery, thus delaying the efficiency of the purchase/transaction. Please contact Ingamex using the feature on the website, or with E-Mail Support listed on the website.
Ingamex reserves the right to verify your account and identity by asking for proof of identification (i.e. proof of billing, credit card statements, passport, etc) during registration and withdrawal of funds.
Ownership and Rights of Interactive Items
Ingamex makes no claims to the rights of any virtual currency, items and characters traded through Ingamex. All virtual items brokered through Ingamex.com are owned by their respective original licensors (eg. Level Up! Games, E-Games, AmPed, Mobius Games, Square Enix CO., LTD., Sony Online Entertainment Inc., Sony Computer Entertainment America Inc., Blizzard Entertainment, NCsoft Corporation, LucasArts Entertainment Company Ltd., Softnyx, etc.) Ingamex is in no way affiliated with the companies listed and is merely performing as an escrow service of the game currency and/or items related to any service provided for each game.
Game Currency/Items/Accounts Ownership
Ingamex sellers must own the game currency, items or characters being traded. Ingamex prohibits the trading of currency/items/characters that are duplicated(duped), stolen, borrowed or acquired in illegal ways. Ingamex will be compelled to release member personal information to the authorities/police/courts during legal investigations/proceedings.
The selling of duplicated, macroed, copied or any kind of mass-produced game currency, items or characters is prohibited. If such items occur, Ingamex has the right to report these activities to the proper authorities. If the game currency, items or characters are duplicated, macroed or copied, Ingamex reserves the right to remove the currency, items or characters from trading, and issue no money to the seller.
Game Currency/Items Purchases and Selling
Ingamex offers NO REFUNDS for any virtual property. All game currency, items and characters are sole properties of their original owners/licensors (eg. Level Up! Games, E-Games, AmPed, Mobius Games, Square Enix CO., LTD., Sony Online Entertainment Inc., Sony Computer Entertainment America Inc., Blizzard Entertainment, NCsoft Corporation, LucasArts Entertainment Company Ltd., Softnyx, etc.) and shall remain so beyond contestation.
Ingamex is not responsible for any loss, in part of in whole, of any currency, items and characters after the trade transaction is completed. Ingamex holds no responsibility for any loss in value of any currency, items and characters. We are not responsible for the banishment or cancellation of buyers' or sellers' (of services, currency, items or characters) personal accounts in game, or financial accounts in real life, as a result of trading at Ingamex.
The buyer remains solely responsible for recording and safekeeping all the necessary and private information in case theft of an account occurs. Spamming, making slanderous or libelous remarks, or threatening in any way is prohibited at all times.
All open contracts may be cancelled. Filled (matched) contracts are final and cannot be cancelled. The members are advised to double-check the prices while making a buy/sell order.
For voided contracts (non-delivery of items, member didn't show up, etc) the exchange fee will be charged to the erring member.
Fees and Payment
In consideration for the use of the Service, you agree to pay to Ingamex a transaction fee for each trade you performed in Ingamex. The applicable fee for your transaction will be provided to you prior to confirmation of the transaction, in addition to any other fees for any other additional services.
Indemnity
You agree to indemnify and hold Ingamex and its subsidiaries and employees, harmless from any claim, cause of action, suit, liability, loss or damage of whatever nature which may arise as a result of or in connection with the use and availment by the members/users of the Ingamex service. The material contained in this site is provided as is without any warranty of any kind unless specifically stated otherwise.
You agree to indemnify and hold Ingamex and its subsidiaries and employees, harmless from any claim, cause of action, suit, liability, loss or damage of whatever nature which may arise as a result of or in connection with the use and availment by the members/users of the Ingamex service specifically in fraudulent access or utilization of the Ingamex service and/or fraudulent or unauthorized transactions in the Ingamex service, due to theft or unauthorized disclosure of member ID, user ID, Password, PIN or violation or non-compliance with other security requirements as set forth in this Terms of Service, with or without the Member's participation.
You agree to indemnify and hold Ingamex and its subsidiaries and employees, harmless from any claim, cause of action, suit, liability, loss or damage of whatever nature which may arise as a result of or in connection with the use and availment by the members/users of the Ingamex service specifically in acquiring, selling and buying of unauthorized or illegal game accounts, game currencies and game items.
With regards to virtual game currency, items or characters, Ingamex only provides a trading and escrow service to its members. These virtual game currency, items or characters and all rights to their intellectual property remain with their original owners/licensors. No tangible goods are being traded at Ingamex. Ingamex is not linked in any way to any of the game owners/licensors, producers, designers or publishers and merely acts as a third party agent, separated from these gaming companies/licensors.
Ingamex does not claim any intellectual property rights/interests held by any of the gaming companies/licensors. As no intellectual property rights are being transferred by Ingamex during any transaction, Ingamex is not responsible regarding the transferability, use and ownership of any of gaming companies'/licensors' intellectual property. The buyer or seller wholly assumes all risk and agree to defend, hold harmless for any claims made by any game companies/licensors in relation to the transaction and use of their intellectual property. Ingamex cautions all its members to avoid violating upon the intellectual property rights of these gaming companies/licensors. Once a transaction is completed, buyers and sellers assume the company's station merely as a license of these companies to use its intellectual property and grant Ingamex with indemnity from the entire transaction with the buyer/seller.
Modifications of Service
Ingamex reserves the right to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice at any time and from time to time. You agree that Ingamex shall not be held liable to you or to any third party for any modification, suspension or discontinuance of the Service.
Termination
You agree that Ingamex in its sole discretion, may terminate your account (or any part thereof) or use of the Service, and remove and discard any Content within the Service, for any reason, including, without limitation, for lack of use or if Ingamex believes that you have violated or acted inconsistently with the letter or spirit of the Terms of Service. Ingamex may also in its sole discretion and at any time discontinue providing the Service, or any part thereof, with or without notice. You agree that any termination of your access to the Service under any provision of this Terms of Service may be effected without prior notice, and acknowledge and agree that Ingamex may immediately deactivate or delete your account and all related information and files in your account and/or bar any further access to such files or the Service. Further, you agree that Ingamex shall not be held liable to you or any third-party for any termination of your access to the Service.
Disclaimer and Warranties
You expressly acknowledge and agree that:
1.Your use of Ingamex services is at your sole risk. Ingamex is provided on an "as is" and "as available" basis. To the fullest extent permitted by applicable law, Ingamex expressly disclaims all warranties, conditions and other terms of any kind, whether express or implied, including, but not limited to any implied term of merchantability, satisfactory quality, fitness for a particular purpose, and any term as to the provision of services to a standard of reasonable care and skill or as to non-infringement of any intellectual property right.
2. Ingamex makes no warranty about (i) service to meet your requirements, (ii) service interruption, timely, secure, or error-free, (iii) results that may be obtained from the use of the service will be accurate or reliable, (iv) the quality of any products, services, information, or other material purchased or obtained by you through the service to meet your expectations, and (v) any errors in the software will be corrected.
3. No advice or information, whether oral or written, obtained by you from Ingamex or through or from the Service shall create any warranty or other obligation not expressly stated in the Terms of Service.
Notices
Notices to you may be made via either email or regular mail. The Service may also provide notices of changes to the Terms of Service or other matters by displaying notices or links to notices to you generally on the Service.
Copyrights, Licenses and Trademarks
Ingamex.com.ph, the ingamex.com.ph logo and other Ingamex logos and product and service names are trademarks of Ingamex Inc. (the "Ingamex Marks"), whether or not registered. Without Ingamex's prior permission, you agree not to display or use in any manner.
You may print and download portions of material from the different areas of the site solely for your own non-commercial use provided that you agree not to change or delete any copyright or proprietary notices from the materials. You agree that you shall have no recourse against Ingamex.com.ph for any alleged or actual infringement or misappropriation of any proprietary right in your communications to ingamex.com.ph.
Publications, content, products or services referenced herein or on the site are the exclusive trademarks or servicemarks of Ingamex.com.ph. Other product and company names mentioned in the Site may be the trademarks of their respective owners.
General Information
These Terms of Service (including the guides and rules referred to herein) constitute the entire agreement between you and Ingamex and govern your use of the Service, superseding any prior agreements between you and Ingamex. Any failure by Ingamex to exercise or enforce any right or provision of the Terms of Service shall not constitute a waiver of such right or provision. If any provision of the Terms of Service is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties' intentions as reflected in the provision, and the other provisions of the Terms of Service remain in full force and effect.
Neither you nor Ingamex may assign or transfer any rights or obligations under these Terms of Service without the prior written consent of the other party, except that Ingamex shall be entitled to assign or transfer any or all of its rights and obligations (without your prior consent) to any of its affiliated companies.
The section titles in the Terms of Service are for convenience only and have no legal or contractual effect. No Right of Survivorship and Non-Transferability. You agree that your Ingamex account is non-transferable and any rights to your Ingamex ID or contents within your account terminate upon your death. Any account that has not been used for a long period of time may be terminated and all contents therein permanently deleted in line with Ingamex's policy.
